These terms and conditions (the «Terms») govern access to and use of the website donotaku.com, its subdomains and any related service (together, «DonOtaku», the «Service», «we» or «us»). By accessing, browsing, registering or using the Service in any way, you accept these Terms in full, together with the privacy policy. If you do not accept them, you must not use the Service.
1. Contact
Any communication about these Terms, the Service or your account must be sent through our contact form.
2. The Service
DonOtaku is a database of anime and manga with information, synopses, a release calendar, news, personal lists, ratings and comments. DonOtaku does not host, distribute or link to episodes, chapters or any unauthorised copy of the works, and it is not affiliated with, endorsed by or sponsored by the studios, publishers or rights holders of the works it lists.
We may modify, extend, limit, suspend or discontinue the Service or any part of it, at any time, temporarily or permanently, with or without notice, and without this giving rise to any right to compensation.
3. Age and capacity
To register or publish content you must be at least 18 years old and have full legal capacity to accept these Terms. By registering you declare that you meet these requirements. If we detect that they are not met, we will close the account.
4. Your account
- The information you provide must be true, accurate and up to date. The account is personal and non-transferable: it may not be shared, sold or used on behalf of third parties.
- You are solely responsible for the confidentiality of your credentials and for everything done from your account, whether or not you authorised it. You must notify us immediately of any unauthorised use.
- Usernames that impersonate other people, brands or DonOtaku itself, that are offensive or that infringe third-party rights are not allowed; we may change or withdraw them.
- We may suspend, restrict or close any account, and remove its content, at our discretion, if we consider that these Terms, the law or the rights of third parties have been breached, or to protect the Service or other users, without prior notice when the seriousness of the case so requires.
- You can ask us to close your account through the contact form. Closing the account does not affect the assignment of rights over content already published (section 6).
- If you had an account on the previous version of DonOtaku, it has been moved to the current Service and is governed by these Terms from your next access.
5. Content you publish
«User Content» means everything you publish or send through the Service: comments, reviews, ratings, lists, usernames, avatars, reports, suggestions, messages and any other text, image or material.
- You are solely and exclusively responsible for your User Content and for the consequences of publishing it. DonOtaku does not review it before publication, does not endorse it and does not share the opinions expressed in it.
- You guarantee that you own your User Content or hold all the rights, licences and permissions needed to publish it and to make the assignment in section 6, and that it does not infringe the law, these Terms or any third-party right (intellectual or industrial property, honour, privacy, personal image, data protection or any other).
- We have no obligation to store, keep, display or back up your User Content, and we may edit, hide, move or delete it at any time, at our discretion and without notice.
6. Rights over your User Content
By publishing User Content, you assign to DonOtaku, free of charge, on an exclusive basis, for the maximum duration permitted by law, worldwide and with the right to sublicense and transfer to third parties, all the exploitation rights over that content — reproduction, distribution, public communication, making available and transformation, including translation, adaptation, editing, excerpting and combination with other content— in any format, medium or channel, known or yet to be invented, and for any purpose, including commercial ones (for example, displaying it on the website, in apps, newsletters, social networks, advertising or promotional material, or using it to improve the Service).
- This assignment does not end when you delete the content or close your account with respect to uses already made, copies included in backups or content that has been quoted, answered or incorporated into other content or compilations.
- To the extent permitted by law, you waive the exercise of any right that could prevent or limit these uses, and you agree that DonOtaku may use your content with or without citing your username.
- Being exclusive, from the moment of publication those rights belong to DonOtaku: you may not exploit that content elsewhere or authorise third parties to do so. The moral rights that the law does not allow to be assigned, such as being recognised as the author, remain yours.
- You will receive no payment or compensation for these uses.
- Suggestions and feedback you send us about the Service become the property of DonOtaku, which may use them freely and without any obligation towards you.
7. Rules of conduct
When using the Service, you may not:
- Publish content that is illegal, defamatory, insulting, threatening, harassing, hateful, discriminatory, violent, obscene or that incites crime.
- Publish sexual content involving minors, in any form, real or fictional. This will be reported to the authorities.
- Publish or link to pirated copies of episodes, chapters, films, books or any protected content, or explain how to obtain them.
- Publish personal data of third parties, or infringe their privacy or image.
- Publish spam, advertising, chain messages, affiliate links or repeated content, or use the Service for commercial purposes without our written authorisation.
- Impersonate any person or entity, or misrepresent your affiliation with them.
- Publish spoilers without warning where the Service allows it to be avoided.
- Access or extract content or data by automated means (bots, scrapers, crawlers other than search engines), overload the Service, attempt to bypass its security, limits or captcha, or access areas or accounts that are not yours.
- Introduce viruses or any harmful code, or interfere with the proper functioning of the Service.
- Create multiple accounts to evade a suspension, manipulate ratings, votes or rankings, or coordinate false reports.
- Copy, reproduce or reuse the content, design or database of DonOtaku (section 8).
8. Intellectual property of DonOtaku
- The Service and all its elements —texts, synopses, descriptions, news, translations, design, logos, the DonOtaku name and brand, graphics, code, and the database as a whole, its structure, selection and arrangement— are owned by DonOtaku or used with authorisation, and are protected by intellectual and industrial property law, including the sui generis right of the database maker.
- You may view the content for your personal, non-commercial use. Any other use —reproduction, distribution, public communication, transformation, extraction or reuse of all or a substantial part of the content or the database, including by automated means— is prohibited without our prior written authorisation.
- Some synopses, descriptions and texts are produced with the help of artificial intelligence and reviewed or edited by DonOtaku; they are also covered by this section.
- Part of the catalogue data comes from public sources (AniList, MyAnimeList, MangaDex, Kitsu, MangaUpdates and others). Covers, posters, characters, titles and trademarks of the works belong to their respective rights holders and are shown to identify each work and inform about it.
- Nothing in these Terms grants you any licence or right over the intellectual or industrial property of DonOtaku, beyond what is expressly stated.
9. Rights claims
If you believe that any content on DonOtaku infringes your rights, write to us through the contact form indicating: your identity and, if applicable, who you represent; the exact content and its address; the rights you hold; and a statement that the information is accurate. We will review it and, where appropriate, remove or block the content. Knowingly false claims may give rise to liability.
10. Information on the Service
The information on DonOtaku (titles, dates, schedules, episodes, chapters, staff, ratings, synopses, news) is offered for informational purposes only. It comes in part from third parties and from automated processes, and may be incomplete, inaccurate or out of date. Release times and dates may change without notice. We do not guarantee its accuracy, completeness or timeliness, and it must not be relied upon for decisions of any kind.
11. Links, embedded content and third-party services
The Service includes links to other websites and content from third parties (videos, posts from social networks, AI assistants, sharing buttons). DonOtaku does not control them, does not endorse them and is not responsible for their content, availability, privacy policies or practices. Your use of them is at your own risk and under their own terms.
12. Disclaimer of warranties
The Service is provided «as is» and «as available». To the extent permitted by law, DonOtaku gives no warranty of any kind, express or implied, including warranties of availability, continuity, accuracy, fitness for a particular purpose, security or absence of errors, viruses or interruptions.
13. Limitation of liability
To the maximum extent permitted by law, DonOtaku, its owner and its collaborators shall not be liable for:
- User Content or the conduct of users or third parties, inside or outside the Service.
- Errors, omissions or inaccuracies in the information, or decisions taken on the basis of it.
- Interruptions, suspensions, loss of data, lists or content, or failures of the Service, whatever their cause.
- Damage caused by viruses or harmful code, or by unauthorised access to your account due to a lack of diligence on your part.
- Indirect damages, loss of profit, loss of data, reputation or opportunity.
In any case, and whenever the law so permits, DonOtaku's total liability towards you shall not exceed one hundred euros (100 €). Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as that arising from wilful misconduct or gross negligence, or the rights that consumer protection law grants you.
14. Indemnity
You agree to indemnify and hold harmless DonOtaku, its owner and its collaborators against any claim, action, sanction, damage, loss or expense (including reasonable legal and attorney's fees) brought by third parties or by authorities arising from your User Content, your use of the Service or your breach of these Terms or of the law.
15. Advertising and commercial content
DonOtaku may include advertising, sponsored content, affiliate links or other forms of monetisation, now or in the future, which may be displayed alongside User Content. You will have no right to any consideration for this.
16. Changes to these Terms
We may modify these Terms at any time. The date at the top indicates the version in force. If the changes are substantial, we will announce them on the Service or by email. Continuing to use the Service after the changes means you accept them; if you do not accept them, you must stop using the Service and may ask us to close your account.
17. General
- If any clause is declared void or unenforceable, it will be limited to the minimum extent necessary, and the rest of the Terms will remain in force.
- Our failure to exercise a right or clause does not mean we waive it.
- We may assign our rights and obligations under these Terms to a third party, for example in the event of a transfer of the Service. You may not do so without our consent.
- We are not liable for failures caused by events beyond our reasonable control (force majeure).
- These Terms, together with the privacy policy, constitute the entire agreement between you and DonOtaku regarding the Service. The Spanish version prevails in the event of a discrepancy between languages.
18. Applicable law and jurisdiction
These Terms are governed by Spanish law. Any dispute will be submitted to the courts of Spain, without prejudice to the mandatory rights that consumer protection law grants you, including the right to go to the courts of your place of residence.
